As you can read in numerous blog they organized several operations targeted at domain seizures and they fulfilled is successfully.<br />
One of the things that bothers me most of all is that in fact it is beginning of internet censorship. </p>
<p>Thus, one of the oldest torrent searches lost his domain. Domain torrent-finder.com was seized not looking at it`s operations. Torrent-finder is a frame search engine, that means that it show torrent search results in a different frames depending what sites user prefers more. Generally, only the list of torrent sites and predefined search search templates was stored on torrent-finder.com.</p>
<p>Anyway, ICE decided to close it. Guys, that`s terrible. No confidence. Who is next?<br />

This is a new domain zone that is going to be independent from top level ICANN powered domain name servers. As you know ICANN is considered to be international non commercial organization but in fact it is under U.S. Immigration and Customs Enforcement.</p>
<p>That means that US in fact controls domain name system and by this fact may block access to any resource (access still may be possible by IP address but people used to recognize internet sites by domain names but not by IP addresses).</p>
<p>To avoid this usurpation of power in internet it is very important to go ahead with the p2p domain project.<br />
By this tiny post I would like just to express my solidarity and claim that agree to promote this idea and let everyone know about this technical innovation as soon as it is ready.</p>
<p>Internet is an treasure that brought a real independence and freedom of speech. Let`s keep it.<br />

In special cases judges can even raise this sum to 150.000 dollars per track if defendant’s actions are proved to be malicious! One can even risk his life, as you will see from this article!</p>
<p>1. We start our countdown from poor thing Siara Sauro. This teenager suffered from RIAA last year, which won 8000 dollars in the legal proceeding for the fact that <strong>poor young girl uploaded into the internet 10 tracks, which was a break of the Copyright Law</strong>. Siara tried to ensure the judges that she had not uploaded any of these songs, and the account, from which all the tracks had been uploaded, belonged to her father, who left the family many years ago.</p>
<p>2. Appeal court of the United States of America made a student pay <strong>27.700 dollars for 37 tracks, which were protected by the Copyright Law</strong>. The court didn’t even try to take into consideration the fact, that she was very young and just could not understand that she had been doing something illegal while loading those songs. At first, she was fined for 7400 dollars ($200 for every song), but Appeal Court of New Orleans decided that she should pay $740 for every track that she had uploaded.</p>
<p>3. During year 2005 there used to be a very wide-spread story about a <strong>single mother Tanyi Andersen</strong>. Sound-recording companies accused her of spreading pirate versions of audio tracks. The MediaSentry agents, who had been hired by the RIAA, found out, that divorced mother had visited KaZaA network under a specific login and loaded “gangsta” rap. Anderson tried to prove that she had never dealt with the file sharing really hard, and even offered to check the hard disk of her computer. But RIAA ignored her offers and made her pay compensation.</p>
<p>4. Here is another shocking case. An action was brought to a 66 year old sculptor <strong>Sarah Ward from Massachusetts</strong>. She told the judges that she even did not know how to proceed the file sharing. As a result, Sarah was accused of spreading more than two thousand audio tracks among users of p2p network. However, councils for the defense managed to persuade the judges that Sarah and her husband used their computer only for communicating with their children. After that lawyers from RIAA brought their action back. But they keep the right to start this case again if they find it necessary. Sarah and her husband were about to pay more than 160.000 dollars.</p>
<p>5. Five Hollywood film studios are now trying to get compensation in the amount of <strong>432.000 dollars from the Chinese web-site and Internet-café</strong>, which illegally offered to load “The Pirates of the Caribbean” and some other popular films. This website, which is called Jeboo.com, presents itself as an online cinema, stressing that it is the biggest archive of movies, which has more than 30.000 of films and soap operas. The case is going to take place in the court of Shanghais and is the next level of war between the United States of America and China.</p>
<p>6. On 31 of June 2009, 25 year old graduate Joel Tenenbaum was sentenced to pay a fine in the amount of <strong>675.000 dollars for loading and spreading a set of musical compositions</strong> with the help of file sharing systems. Firstly, four sound-recording companies called him for paying 4.500.000 dollars ($150.000 for every track), but eventually, he paid 22.500 dollars per track.</p>
<p>7. Another student from Pennsylvania was also <strong>fined for 700.000 dollars</strong> for loading and spreading popular films and music videos among the majority of the students, who lived in a dormitory. He didn’t refuse the fact that he had broken the law, however it did not decreased the amount of payment for sound-recording studios.</p>
<p>8. 32 year old single mother Jamey Thomas, who lives in Minnesota <strong>has to pay 1.920.000 dollars</strong> ($80.000 for every song that she has loaded) to famous sound-recording companies, such as Sony BMG Music, Capitol records, Warner Brothers and other companies. It took 5 hours in order to announce the decision of the court.</p>
<p>9. One of the most popular cases regarding the Internet piracy during the last years was connected with the torrent-tracker “The Pirate Bay”. The administrators of the tracker were put into prison and were also made to pay a fine <strong>in the amount of 3.600.000 dollars</strong>.</p>
<p>10. But the most shocking thing took place in Afghanistan. <strong>A 23 year old man was sentenced to death penalty</strong> by the authorities of Afghanistan for loading and spreading among the students of the same year documents, where some traditions and customs of Islamic countries were criticized. His name was Sayed Pervez Kambaksh. Everyone who tried to help was warned by the local government, that one would be immediately arrested.</p>

			<content:encoded><![CDATA[<p>Five years ago, when most BitTorrent sites had only a handful of visitors, ShareConnector was serving eDonkey links to millions of file-sharers every month. This popularity didn’t go unnoticed by the local authorities, who were tipped off by BREIN and started a criminal investigation into the operator of the site, as well as the people behind the site Releases4U.</p>
<p>What followed was more than 5 years of legal battles in both civil and criminal court cases. In the criminal case the operator of ShareConnector came out as the winner in 2007 and was released from all charges.</p>
<p>The court ruled that the authorities failed to provide any evidence to prove ShareConnector was involved in copyright infringement nor enough to prove that it was criminal in nature. In addition, the judge ruled that the initial arrests were unlawful as the evidence provided by BREIN was insufficient.</p>
<p>After this decision ShareConnector came back online. However, this comeback was short lived as local anti-piracy outfit BREIN initiated a civil lawsuit, trying to prevent the operator from keeping the site up and running. This lawsuit was won by BREIN but the ShareConnector operator decided to appeal the ruling.<br />
<span id="more-27"></span><br />
This week a court announced the verdict of the appeal and it came out negative once again. Although the court ruled that the operator of ShareConnector wasn’t guilty of copyright infringement, it said the site must remain closed for good. The judge ruled that sites that offer hash links (like .torrent links) are facilitating copyright infringement, an unlawful behavior.</p>
<p>The outcome of the case is disappointing to aDI, the operator of the site, who further said that it didn’t surprise him. He had hoped, however, that the ruling in the appeal would be in line with recent cases in Spain where P2P indexing sites were deemed legal.</p>
<p>“The results are just what I expected, so nothing surprising here considering all the similar recent cases with just about the same conclusion we see here. The trend has been set by those ignorant old judges that fail to see the logic, contradicting the rulings from Spain,” said aDi in a response to the verdict.</p>
<p>“Unfortunately this is not Spain, the Dutch legal system is dysfunctional, lacking logic and professionalism. Why does it take more than five years and so many criminal trials to prove a simple fact? How come all the pathetic private organizations whose main interest is money and not the artists, get away with lies and deceptions spreading their propaganda in the media?,” he added.</p>
<p>What remains for the ShareConnector operator is the appeal of the criminal case that will be heard in April. In 2007 he was released from all charges, but after two years the Department of Justice filed the appeal. The charges in this case are membership of a criminal organization and (assisting in) the distribution of copyrighted material. The additional charges of copyright infringement were dropped last week.</p>
<p>In the upcoming trial Dr. Johan Pouwelse will appear as an expert witness on behalf of the defendant. Since downloading copyrighted films and music is not illegal in The Netherlands, he is expected to testify that there are various ways for eDonkey users to disable the upload feature. Whatever the outcome of the criminal trial, ShareConnector will never return.</p>

			<content:encoded><![CDATA[<p>Large scale web-services such as Twitter need thousands of servers to manage the flow of updates that are sent out by their millions of users. As a result, keeping all these servers updated with the latest data can be time and resource intensive.</p>
<p>To improve the deployment of files across their servers, Twitter is calling in the help of BitTorrent. With BitTorrent, Twitter is planning to distribute files faster and more efficiently, saving time and precious resources and improving the scalability of Twitter’s operation.</p>
<p>Twitter’s new project, codenamed ‘Murder’, will not use the bandwidth of Twitter users. Instead, it will transform the site’s servers into a large BitTorrent swarm that will distribute file updates using BitTorrent technology.<br />

The setup is pretty straightforward. Murder uses a ’seeder’ server where the new files will be distributed to thousands of ‘peer’ servers.</p>
<p>Because all servers assist in the deployment of the files, it will only take a fraction of the time it would otherwise take when files are distributed from a central server. This server-to-server BitTorrent technology also explains the name ‘Murder’ which is used to describe a flock of crows.</p>
<p>The Murder project is developed by Twitter’s Larry Gadea and built based on the BitTornado BitTorrent client, which was the first client to implement web-seeding. The code is open to the public and licensed under the free software Apache License.</p>
<p>Eric Klinker, CEO of BitTorrent Inc. is excited about Twitter’s adoption of BitTorrent. “We are thrilled to collaborate with them on this and hope that more Web Monsters out there look to this and other applications of BitTorrent in solving some of the hard problems of the Internet,” he said.</p>
<p>“The distributed nature of BitTorrent means an operation that once took many dozens of minutes, now happens in less than a dozen seconds. These efficiencies will reduce maintenance windows, site downtime and exposure to security vulnerabilities,” Klinker added. Although Klinker speaks about “collaboration” with Twitter it is not clear what role BitTorrent Inc. will play in the Murder project.</p>
<p>At this point it is still unclear when Murder will be implemented or released to the public but Twitter is expected to release more details on the upcoming project in the weeks to come. </p>

			<content:encoded><![CDATA[<p>UseNeXT is a brand operated by Munich and London-based company, Aviteo Ltd. UseNeXT is one of the most popular Usenet services around today and has traditionally advertised extensively within the BitTorrent community and on many torrent sites.</p>
<p>On 19 December 2006, performing rights group GEMA, which handles the copyrights of more than 1 million rightsholders worldwide, filed for an injunction against UseNeXT. GEMA had earlier leveled accusations at UseNeXT’s advertising in which it said, among other things, the company claimed to offer 1 million MP3s through its service.</p>
<p>“[UseNeXT] advertised its fee-based access with unambiguous references to illegal exchange platforms. In particular it publicized the anonymity, speed and security of access to contents available on Usenet,” GEMA said in a statement, adding: “On top of that, the service also offers special, perfected search software that makes it easier to locate and manage musical works and other contents protected by copyright.”<br />
<span id="more-43"></span><br />
On 18 January 2007, the Hamburg District Court issued a preliminary injunction against UseNeXT’s operators, which included instructions for it to change the way in which it advertised its product and barring it from providing musical works from GEMA’s repertoire. UseNeXT objected to the decision and disputed that it had ever encouraged subscribers to download copyright works, arguing that its use of the terms ‘unfiltered’ and ‘anonymous’ related to features inherent in the Usenet system.</p>
<p>On 17 February 2010, the Hamburg District Court handed down a preliminary injunction against UseNeXT which bars the service from offering a sample 100 musical works to which GEMA administers the copyright. The injunction also states that UseNeXT must go further than simply modifying its advertising in order to protect GEMA’s copyrights.</p>
<p>Although not necessarily liable for infringements, the Court said that Usenet providers would have to take responsibility for the services and environments they provide.</p>
<p>In a statement, GEMA said that the Court of Hamburg’s decision represents expanded liabilities for Usenet providers which go further than regulating their approach to advertising, but also apply when modified advertising proves insufficient to protect rights holders.</p>
<p>“The adoption of the preliminary injunction is a success in our commitment to the protection of copyright,” said Dr. Harald Heker, Chief Executive Officer of GEMA. “Second, the ruling also represents a further important step towards a comprehensive responsibility of the Usenet service operator for its offer.”</p>
<p>At this stage it’s unclear how UseNeXT will choose to comply with the injunction. Unlike services such as Rapidshare that operate their own servers and actually store content, UseNeXT are a reseller of the Highwinds Usenet service. UseNeXT does not store any content, Highwinds do.</p>
<p>UseNeXT used to offer a search engine and software interface to access Usenet, so conceivably something could’ve been implemented there to bar access to the GEMA titles mentioned in the injunction. However, recent changes to their service means they are no longer offering those solutions but suggesting the use of 3rd party software, with one particular solution from Tangysoft up front.</p>
<p>Nevertheless, the Court said that UseNeXT is responsible for the service it’s re-selling so the company will have to find an answer somehow. Many Usenet providers are already working with rights holders to automate the removal of content, so solutions are available. How quickly and comprehensively UseNeXT acts will remain to be seen.</p>

			<content:encoded><![CDATA[<p>In the hope of dismantling BitTorrent’s flagship The Pirate Bay, anti-piracy outfit BREIN took three of the site’s founders to court this summer. BREIN won the case and Fredrik, Gottfrid and Peter were ordered to prevent Dutch users from accessing the site, a decision appealed in October without luck.</p>
<p>In its verdict the Court ruled that the three defendants had to remove a list of torrents from The Pirate Bay that link to copyrighted works. The three defendants and the site itself were not found guilty of copyright infringement, but according to the Court, The Pirate Bay assists in copyright infringement by allowing and encouraging its users to share torrents.</p>
<p>The Court gave the defendants until March 1 to remove a list of infringing torrents and to block Dutch users from accessing parts of the site where (.torrent) links to copyrighted files can be downloaded. If the three did not comply they would face penalties of 3,000 euros per person, per day.<br />
<span id="more-45"></span><br />
This ultimatum passed today and thus far no changes have been made to The Pirate Bay. Dutch users can still access all parts of the site and from the looks of it no torrent files have been removed. To the three defendants this comes as no surprise because they always claimed that they have no control over the site anymore.</p>
<p>Peter Sunde, former Pirate Bay spokesman and one of the defendants in this case, told TorrentFreak last week that he doubted that anything would change. Sunde also repeated what was said in Court by their lawyers. The three defendants are no longer in charge of The Pirate Bay and can’t comply with the Court order even if they wanted to.</p>
<p>For BREIN, who celebrated the verdict as a grand victory, The Pirate Bay’s continued operation in The Netherlands is likely to be received as a huge setback. TorrentFreak contacted BREIN director Tim Kuik for a response to the news but we haven’t heard back from him at time of publication.</p>
<p>Meanwhile, The Pirate Bay remains the most popular BitTorrent site in The Netherlands where the site is listed in the top 50 of most visited sites on the Internet, beating Microsoft’s search engine Bing.com.</p>
